Terms of Use
This Terms of Use Agreement (the “Terms” or this “Agreement”) is entered into by and between ProjaTec LLC (“ProjaTec”, “we”, “us”, or “our”) and you as a user (“you” or “User”).
These Terms govern your access to and use of the bolomobile application for phones, tablets, and other devices, and any related online, mobile, or other services (collectively, the “Service”).
These Terms also incorporate our Privacy Policy, unless explicitly stated otherwise in this Agreement.
By creating an account, downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
We may update or modify these Terms from time to time in our sole discretion. The most recent version will supersede all prior versions. It is your responsibility to review the current Terms; your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
A failure to abide by these Terms may result in suspension or termination of your account and/or access to the Service.
We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, temporarily or permanently, with or without notice.
You must be at least 13 years old to use the Service. Additional eligibility requirements may apply under applicable law in your jurisdiction.

2. Accounts and Registration
2.1 User information and personal data
When you create an account, we may ask you to provide certain information such as your name, email address, and other details needed to operate the Service and manage our relationship with you.
You agree to provide accurate, current, and complete information and to update it as needed. Our collection and use of personal data are described in our Privacy Policy available here.
We may decline to register any account or username that we determine, in our sole discretion, is offensive, misleading, impersonates someone else, or otherwise creates a risk of confusion or abuse.
You may contact us at help@bolo.boats to request information about the personal data we hold about you and to exercise your rights under applicable data protection laws.
2.2 Registration information and security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You may not sell, transfer, license, or assign your account or any account rights to any third party without our prior written consent. Attempting to do so may result in suspension or termination of your account.
If you become aware of any unauthorized use of your account or any other breach of security, you must notify us immediately at support@bolo.boats.
3. Free Service; No Fees
The Service is currently provided free of charge to Users.
We reserve the right to introduce paid features, subscriptions, or other fees in the future. If we do so, we will notify you in advance and may require you to accept additional or revised terms before accessing paid features.
You are responsible for any mobile data, internet, or other third-party charges incurred in connection with your use of the Service.
4. Using the bolo Service
4.1 Personal, non-commercial use
Unless otherwise expressly authorized by us in writing, the Service is provided solely for your personal, non-commercial use.
You agree that you will not:
- Access or use the Service in any manner not expressly permitted by these Terms.
- Reproduce, duplicate, copy, sell, trade, resell, or exploit any part of the Service for any commercial purpose without our prior written consent.
- Scrape, index, or systematically retrieve data from the Service, whether manually or via automated means, except as expressly permitted in a written agreement with us.
You are responsible for all activity that occurs under your account and agree not to use the Service to upload, post, transmit, share, store, or otherwise make available content that is harmful, threatening, harassing, unlawful, defamatory, infringing, fraudulent, obscene, or otherwise objectionable.
4.2 Prohibited conduct
In addition to the above, you agree that you will not:
- Violate any applicable law, regulation, or third-party right.
- Attempt to gain unauthorized access to the Service or related systems or networks.
- Interfere with or disrupt the operation of the Service or any User's enjoyment of the Service, including by introducing viruses, malware, or other harmful code.
- Use the Service to send spam, unsolicited advertising, or other forms of solicitation.
- Attempt to bypass or circumvent any security or access control measures of the Service.
We may, in our sole discretion and without notice, remove content, suspend access, or terminate accounts for conduct that violates these Terms or that we deem harmful to the Service or other Users.
4.3 Minors
We do not knowingly collect or use personal information from individuals under 13 years old (allowable boating license age in most of the United States).
If we become aware that a minor under this age has provided personal information, we will take steps to delete such information and may terminate the related account.
5. Crowdsourced Reports and User Responsibilities
5.1 Nature of crowdsourced content
bolo relies on reports and other content submitted by Users. These reports are crowdsourced and are not independently verified, moderated, or reviewed for accuracy or completeness before being made available through the Service, except as we may decide in our sole discretion.
You understand that the quality, accuracy, and reliability of such User-generated reports may vary and that you use and rely on them at your own risk.
5.2 Commitment to accurate and non-misleading data
By using the Service, you agree that:
- You will not intentionally submit false, inaccurate, or misleading reports or data.
- You will not fabricate events, incidents, locations, or other information.
- You will not impersonate any person or entity or misrepresent your affiliation with any person or entity.
- You will promptly correct or remove any content you have submitted that you later discover to be inaccurate or incomplete, where the Service provides such functionality.
Submitting knowingly false or misleading information is a violation of these Terms and may subject you to account suspension or termination and, in some cases, to legal liability.
5.3 No emergency, safety-critical, or professional use
The Service is not designed or intended for emergency response, safety-critical decision-making, or professional use where inaccurate or delayed information could lead to injury, loss, or damage.
You must not rely on the Service as the sole or primary source of information for making decisions that could impact your safety or the safety of others.
6. No Navigation or Turn-by-Turn Use
bolo is not a navigation application and must not be used for navigation of vehicles, vessels, aircraft, or persons, including but not limited to turn-by-turn guidance, routing, or any primary means of determining position or direction.
You acknowledge and agree that:
- The Service does not provide certified or authoritative navigation data.
- The Service is not a substitute for official government maps, nautical charts, aviation charts, road signage, or other official navigation resources.
- You remain solely responsible for your own navigation decisions and for complying with all applicable navigation, safety, and traffic laws and regulations.
We disclaim any liability for damages, losses, or injuries arising out of or related to any use of the Service for navigation or routing purposes.
7. Third-Party Services and Mapbox
The Service may integrate with or provide links to third-party services, content, or functionality, including mapping and location services provided by Mapbox.
7.1 Mapbox and mapping projections
The Service uses Mapbox for mapping, visualization, and related geospatial functionality. You acknowledge that:
- All map data and projections are subject to standard mapping projection errors, including positional inaccuracies, scale distortions, and incomplete or outdated information.
- Geographic features, points of interest, roads, boundaries, and other mapped elements may be inaccurate, misaligned, missing, or not up to date.
You must not rely on the maps or geospatial data provided through bolo as precise, authoritative, or complete, and you assume all risk associated with your use of such data.
7.2 Third-party terms
Your use of Mapbox and other third-party services through bolo may be subject to separate terms and conditions and privacy policies provided by those third parties.
We are not responsible for, and do not endorse, any third-party services, products, content, or terms, and you use them at your own risk.
8. Intellectual Property
8.1 Our content and rights
The Service, including all software, design, text, graphics, images, video, logos, trademarks, and other content, and all intellectual property rights therein, are owned by ProjaTec or its licensors.
Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service or any part of it.
You may download or view content from the Service solely for your personal, non-commercial use, and only to the extent permitted by these Terms.
8.2 User content and license
You retain any ownership rights you may have in the content (including reports, text, images, feedback, and other materials) you submit or upload to the Service (“User Content”).
By submitting User Content, you grant ProjaTec a worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, host, store, reproduce, modify, create derivative works from, publish, display, and distribute your User Content in connection with operating, improving, and promoting the Service and our business.
You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe, misappropriate, or violate any third-party rights or any law.
8.3 Feedback
If you provide feedback, ideas, or suggestions regarding the Service (“Feedback”), you acknowledge that we may use such Feedback without restriction and without any obligation to compensate you.
9. User Content Standards and Enforcement
You are solely responsible for User Content you submit and for all activity under your account.
You agree not to submit User Content that:
- Is unlawful, defamatory, harassing, hateful, discriminatory, obscene, or otherwise objectionable.
- Contains viruses, malware, or other harmful components.
- Infringes any copyright, trademark, privacy, publicity, or other rights.
- Contains spam, unsolicited advertising, or fraudulent schemes.
- Consists of false or misleading information, including fabricated events, locations, or reports.
We may, but are not obligated to, monitor, review, edit, or remove User Content in our sole discretion, and may suspend or terminate accounts for violations of these Terms.
We encourage Users to report objectionable, inaccurate or abusive content or behavior via report Thumbs up or Thumbs down or by emailing support@bolo.boats.
10. Indemnification
You agree to indemnify, defend, and hold harmless ProjaTec, its affiliates, service providers, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service.
- Your User Content.
- Your violation of these Terms or any applicable law or regulation.
- Your violation of any rights of a third party.
This indemnity obligation will survive any termination of your account or these Terms.
11. Disclaimers and Limitation of Liability
11.1 General disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, with all faults and without any warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy, completeness, reliability, or timeliness of any content, including User Content and map data.
11.2 Crowdsourced reports and data
Because bolo relies on crowdsourced reports and third-party mapping data, information presented through the Service may be incomplete, inaccurate, delayed, or otherwise unreliable.
You acknowledge that you use the Service and rely on any information obtained through it solely at your own risk.
11.3 No navigation or safety guarantee
The Service is not a navigation tool and does not provide safety-critical information. We disclaim any liability for navigation errors, route decisions, delays, accidents, property damage, personal injury, or death arising out of or related to use of the Service, including any use for navigation or routing.
11.4 Limitation of liability
To the maximum extent permitted by law, in no event will ProjaTec, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your access to or use of, or inability to access or use, the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages.
To the extent permitted by law, our aggregate liability for any claims relating to the Service will not exceed the greater of (a) the total amount you paid us, if any, during the 12 months immediately preceding the event giving rise to the claim, or (b) USD $100.
Some jurisdictions do not allow certain exclusions or limitations of liability; in such cases, the above limitations will apply only to the extent permitted by applicable law.
12. Termination and Suspension
You may stop using the Service and, where applicable, may delete your account at any time through the in-app settings or by contacting support@bolo.boats.
We may, in our sole discretion and without notice, suspend or terminate your access to the Service or your account, in whole or in part, for any reason, including if we believe you have violated these Terms, created risk or possible legal exposure for us, or if we discontinue the Service.
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including, without limitation, intellectual property, indemnification, disclaimers, and limitations of liability) will continue to apply.
13. Governing Law and Dispute Resolution
These Terms and your use of the Service are governed by the laws of the State of Maryland, USA, without regard to its conflict of laws principles.
Any disputes arising out of or relating to these Terms or the Service will be resolved:
- First, by good-faith negotiation between you and ProjaTec; and
- If not resolved, then by the courts as specified below.
13.2 Courts
You and ProjaTec agree to submit to the exclusive jurisdiction of the state and federal courts located in Annapolis, MD for the resolution of any disputes arising out of or relating to these Terms or the Service.
14. Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely reflects the parties' original intent.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
We may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer these Terms, or your rights or obligations under them, without our prior written consent.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by updating the “Last updated” date, sending an email, or displaying a notice in the Service. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them.

16. EU Trader Status
If you are a resident of the European Union, you have the right to know whether you are dealing with a “trader” for the purposes of EU consumer protection laws and the EU Digital Services Act. For these purposes, a “trader” is generally understood to mean any natural or legal person who is acting for purposes relating to their trade, business, craft, or profession. ProjaTec provides the Service in the course of its business activities and therefore acts as atrader when offering the Service to consumers in the EU.

Nothing in this section creates any additional warranty, obligation, or liability beyond those expressly set out in these Terms or required by mandatory provisions of applicable EU law. Where there is a conflict between these Terms and non-waivable rights granted to you under EU consumer law, those mandatory rights will prevail.
